We Should Move Forward as One!
We are witnessing a wave of change in Africa and the Middle-East for the better. As many have said this is an epic change that started unfolding with the series of changes in the East - the fall of the Soviet Union, the collapse of the Berlin Wall and the emergence of the colour revolutions. The change in Egypt was rightly guessed by some as to what it was leading to while others thought it was only a storm in a tea cup. Today, it is conventional to think that this change would not be limited to the Arab world but would knock on the doors of many if not all dictators all over the world.
However, the latest turmoil in Libya has brought a new division between the West and the East in outlook over armed intervention. This is increasingly signifying the new division has its bases more in a world struggle for economic power rather than on issues of freedom and democracy.
However, for politicians in the West there
is more to say. Politicians such as Foreign
Secretary William Hague believe that “this year
will be seen in centuries to come as a key one in the development of human
history”. However, Mr. Hague “warned that if the situation in the Middle East
and Africa went wrong, the effect on the world economy would make the recent
financial crisis seem like a "mere prelude" to greater problems.
We very much agree with Hague on
the epic nature of the changes that have started in the North of Africa,
swiping the Middle East, soon heading to sub-Saharan Africa and according to
the views of John McCain blowing to the East as far as Russia and China.
However, we believe the change will not stop knocking at doors of dictators of
nations all over the world but will also be knocking at the doors of the ‘democracies’
of the world where the same people who are watching changes unfold in the south
and East on their television screens would be asking the very nature of their
own systems - the unfairness in society especially with regard to the distribution
of wealth.
We hope the awakened people in the South and East will not only rid of their dictators and oppressive regimes but with the same energy and awareness fight the roots of under development.
In other words, Mr. Hague, this
change following the Arab-African awakening is heading for a global
transformation where an unprecedented new world order has started to take root
with a forceful participation of the ordinary folk. Thus, we should have less
fear of extremism and terrorism spreading in the present situation as Mr. Hague
warns, as long as people are left to own their direction of change and any
support or intervention is genuine. The basis for significant and sustained
extremity remains to be the very lack of freedom in society and undue foreign
interference. With freedom people have real choices and they should be trusted
to know what is best for them.
With this positive note we would
like to look into the future of our beloved nation, Ethiopia, hopefully the
next in line to receive the torch of change from North Africa. Our
country has been much supported by Britain for the last two decades in
developmental and humanitarian aid as well as diplomatic and military aid
(including training for the police force). But,
unfortunately Britain has been turning a blind eye to atrocious killings and
human right abuses taking place in Ethiopia. Despite this, the Ethiopian people
expect to receive genuine support from the West in deciding over their destiny
and hope Britain will not disappoint them.
Ethiopia hopes to gain the
support of the West when the people rise to take control of their destiny.
Tatek Movement for Freedom, Democracy and Unity for Ethiopia (Tatek) is a
clandestine movement which uses all means, except terroristic means, to
undermine the government and force it to concede to the people’s will. It is at
present preparing with other compatriots to engage the current undemocratic
government peacefully. We have been in the struggle to bring about a democratic
government in Ethiopia for over a decade and have never been closer in real
terms to bringing about what we all struggled for than now - thanks to all
Ethiopian martyrs and those who continue to struggle for democracy despite the
increasing repression and harassment from the
government and also thanks to those martyrs in North Africa and the Middle East
for being the new beacons of change re-motivating our people and maybe also for
making it half difficult for us.
A Call on the Armed Forces
We
are optimistic of Ethiopia’s future. We would like the inevitable change to
take place peacefully and constructively with the minimum loss of life, division
in society and violence. As a movement embedded in the people, we see the
realistic measures or limits of achievable change and thus are willing to
discuss on the nature of the new direction of
change to achieve genuine freedom.
Learning
from the changes in Egypt and understanding the history and very composition of
the Ethiopian armed forces, we recognise the key role the armed forces can play
in bringing about genuine change.
It
is true that the armed forces of Ethiopia are well trained, disciplined and
patriotic. They are also composed of many of
the ethnic groups of Ethiopia. However,
there are issues with the armed forces’ top brass which is totally dominated by
the TPLF- the unofficial ruling party. First of all, as we well
understand the historical and political developments that gave rise to the
balance of power within the armed forces, we choose not to consider this as a
barrier to develop positive relationship. After all, many of these military
leaders once stood against oppression and sacrificed their life for freedom and
change. Therefore, we choose to appeal to them to
understand and sympathise with the rest of the Ethiopian people, including the
ethnic group they come from. They should no more be used as tools for the
interest of a small group of people in the political leadership of the ruling
party.
In
the inevitable uprising that will soon engulf Ethiopia, we believe the military
will have a key role to play. In this situation Meles Zenawi – the dictator who ruled Ethiopia with an iron fist
for the last 20 years- attempts to use all means of division in society. Everyone
knows that Meles’ government has no
mandate to rule as it run a series of unfair and
undemocratic national elections. Under his rule there is no justice in the
country. Nepotism and corruption is rife and that the country’s human rights
record is bad, to say the least. For the sake of fairness we may give the
government some credit for its contribution in developing some of the country’s
infrastructure. However, despite this the armed forces would share with us the
view that the undemocratic and repressive nature of Meles’ government is a great risk for the unity, wellbeing and
future of the country. Thus, we urge the leaders of the military, who may be
more experienced and battle hardened than the Egyptian army, to show
professionalism and resort to tolerance and wisdom embedded in our great
traditions and culture in the circumstances of a people’s uprising or protest.
However difficult it may be, we implore the Ethiopian military to separate
itself from the leadership of the EPRDF when the people arise for change, in
the interest of national unity, democracy and stability.
The
opposition has to work harder to strengthen relationship with the Ethiopian
armed forces and work with them for a peaceful transition. We appeal to them to
recognise that what is to come is a challenge much different and maybe
difficult than what they have ever confronted before. They have to give
priority to national interest and help the Ethiopian people gain power for the
first time through the ballot box. They should help the people of Ethiopia
achieve what they once had aspired when waging a people’s war.
Thus, we plead with them again and again to use this opportunity to bridge the gap between themselves and the Ethiopian people; give a chance to the Ethiopian people; allow a blood less change in Sub-Saharan Africa and be the new beacon in Africa for democratic change.
A Call on Members of the Ruling Party - EPRDF
We
believe that many members of the ruling party, EPRDF, find themselves in the unfortunate
circumstance of present day Ethiopia where free will is undermined by a ruling
clique that has total control not only over political outlook but also on
economic livelihood. On the one hand, many of the members of EPRDF would
be happy to see peaceful change take place to bring about a society without
fear and corruption. But on the other hand, it
would not be surprising if they would be worried of
their association with the party in power in times of change. We want to
reassure them that we understand their circumstances and welcome them to the
camp of change. We offer them the hands of peace, friendship and most of all
fairness. We want them to have the opportunity to correct the past and build a new
future for their children.
A Call on the Tigrian People
Meles Zenawi is infamous for many things in Ethiopian politics amongst
which creating fear in the Tigrian people is typical of his Machiavellian
machinations in trying to prolong his rule. The Tigrian ethnic group is, rather
used to be, the power base of Meles.
In the national elections of 2005 when Meles
was under the threat of losing the elections, he made a case for a similar
incident about to happen in Ethiopia to that of Rwanda and identified the
opposition with Interahamwe, the notorious anti-Tutsi movement that went into
committing genocide of massive proportions. It can be said that this worked well
for Meles to some extent, as some people
from the Tigrian ethnic group believed in the propaganda. Meles took the opportunity of the presence within the opposition
of a few unbridled chauvinists who ruined the day for all and also of some
minor and isolated incidents of violence involving people from the Tigrian
ethnic group. At times, those few chauvinistic and biased elements in the
opposition seemed to have the loudest voice dominating a section of the
opposition and giving it a wrong image. This is regrettable. The great
majority of members of the opposition groups are seasoned and good meaning
people who dedicate themselves to the cause of all peoples of Ethiopia
irrespective of their ethnic, cultural, political or economic origin. Their
persistent call to work with everyone who is a victim of the repression of
EPRDF has not fallen on deaf ears. It is
encouraging to know that more and more Tigrian intellectuals and personalities are
joining the opposition. Early entries to the opposition of prominent Tigrian
personalities include Aregawi Berhe, Siye
Abraha, and the members of Arena Party who are also members of Medrek - the
major opposition alliance in Ethiopia.
Tatek has Tigrian members as much as people from all other nationalities in Ethiopia. Our core value of genuine unity based on democratic principles (including the respect for individual and group rights, the rule of law, separation of powers, and equality) and Meles Zenawi’s unabated oppression of the Tigrian people are increasingly attracting Tigrians to the opposition. We welcome all who adhere to democratic values and respect all differences.
Thus, we call on our fellow citizens from Tigray to reject Meles Zenawi’s xenophobic rhetoric to dissuade Tigrians from participating in the inevitable national uprising or have them at loggerheads with other ethnic groups. We call upon all Tigrian democrats to see the struggle for change in the light of national interest where Tigrians are part of the core. They should join us without any reservation in the efforts being made to see the back of Meles Zenawi and his small group of henchmen and build a new democratic and united Ethiopia.
Conclusion
On the
eventual upraising of the people of Ethiopia, the military will most certainly
have a key role to play and the opposition will have an obligation to find a
way of working with the armed forces to bring about a peaceful transition to a
united and democratic Ethiopia.
We
call on all our members, supporters and fellow Ethiopians, to think of one
another as a family; to show understanding and tolerances; to work on how best
to reconcile differences and move forward together, because that is what
families do! This way we shall prevail – save our people from bloodshed, win
our rights, plant the seed for growth and be an example to others. Violence,
anger, revenge and general negativity towards each other will bring the opposite
and generations to come will blame us for not even applying wisdom of our
forefathers and mothers at time of such great opportunity. Meles Zenawi’s attempt to seclude the Tigrian people and use them
as cannon fodder for his ‘war’ on the Ethiopian people will be foiled and we
shall show the world that Tigrians are not only participants of the struggle
for change but are also equal beneficiaries.
Tatek
is working with others in building up a united front of the opposition and the drawing
up of common strategy and tactics for unified action. We believe that such a massive undertaking
should not be left to ad hoc measures – it should be well planned and
organised. As the government is already in its initial attack phase against the
opposition, i.e. in order to pre-empt the opposition’s calculated move, the
opposition needs to be even better organised and plan to defend the people and
make change happen. It should neither act slowly nor allow itself to be rushed
into action risking the lives and livelihood of many unnecessarily.
On their part, we expect the Ethiopian people to express their views without fear and reservation; to respond peacefully to all provocations and violence; to ignore differences and stand together; to be understanding and readily forgiving to those who want to change sides; to be tolerant and aim to make the repressors accountable rather than be revengeful, biased or aggressive to them. Such practices have their benefits even more so under the unfortunate circumstance of Meles taking the country in the route of Gadafi’s government in terms of minimising the human and material lose and in working our way in the most difficult journey of unifying and democratising the country.
In
order to give a peaceful democratic change a real chance of success and also to
avoid a potential pretext for the government taking more coercive
measures against the people, Tatek is at present considering the suspension of armed
self-defence against the oppressive government.
We
shall wage the struggle for freedom, democracy and unity in a new spirit of
change in unison with other opposition members and the people, to see Ethiopia
continue to be, in the words of a living legend, “A land of many that has
always found a way to move forward as one”*.
United
we triumph!
Victory
to the people of Ethiopia!

WASHINGTON - Several hundred Ethiopians over packed the hall of Trinity Church located at 6000 Georgia Ave, NW, Washington, DC. They were anxiously awaiting the arrival of the 2009 honorees of the event, Brig General Tesfaye Habte Mariam and Brig General Kassaye Chemeda.
Inside the hall, a huge banner over the podium reads: Ye Jegnotch Mishit (Evening of Ethiopian Heroes). Large poster-size, colorful photos of the heroic Generals, Tesfaye Habte Mariam on the left side and that of Gen Kassaye Chemeda on the right hand side, in full military uniform, are embossed on the banner. At the entrance, two large posters are placed on the wall. The writings are in gold on a black background. They are tribute to and representative list of Ethiopian Heroes who gave the ablest leadership to the former armed forces, those who died while heroically fighting in the eastern and northern fronts in defense of Ethiopian unity and territorial integrity. Among those listed, there are names of those members of the armed forces who are still alive. These are representative names from the Army, Airforce, Navy, and the Police commando forces of the former Ethiopian armed forces.
In the entrance area too, members of the former armed forces and members of the organizing committee dressed in jet black suits, white shirts and red tie were greeting and sitting Ethiopians coming to attend the event. Other members of the committee were displaying on a table of items prepared for the occasion, including books written by both generals, Ye Tor Meda Wullo (Reminiscences of the Battlefield) among others.
At 9:00 P.M, as General Tesfaye Habte Mariam and General Kassaye Chemda arrived and entered the hall; they were given salute by three members of the former Army, Navy, and Air force, dressed in their respective uniforms with a military marsh in the background. General Tesfaye and General Kassaye walked through the hallway while members of the former Ethiopian military were standing at both the right and left side, forming in straight line. The hundreds of Ethiopians present expressed their warm welcome with standing ovation until the guests of honor reached the reserved table where they were sited along with disinguised guests of the event Brig. Gen Wubetu Tsegaye, for the former Army, Brig. General Tsegaye Habtiyimer of the former Air force, and other members of the former armed forces.
Artist Tamagne Beyene, the master of ceremony for the occasion, formally announced the arrival of the two heroes amidst rounds and rounds of applause of Ethiopians who came for the occasion. Dinner was followed by a speech by Ato Brehanu Wolde Selassie, the chairman of the Association of the former Ethiopian Air force (AMFEA) and the chairman of the North America organizing committee to honor Ethiopian Heroes. He welcomed General Tesfaye Habte Mariam, and General Kassaye Chemeda, the honorees of 2009. He then explained about the aim and purpose of the non-profit and non-political committee composed of the Association Former members of the Ethiopian Air force (AMFEA), Ethiopian Veterans Association (EVA), and prominent artists and Ethiopians. He stated the importance and the need for nurturing and further developing the culture of recognizing and honoring Ethiopians who give much for their county and people while still alive, especially all those who put their life in line of great danger to defend the unity and territorial integrity of Ethiopia. He recalled the successful event organized by the committee in 2008 to honor Brig. General Legesse Tefera, the air force pilot who fought heroically during the Ethio-Somali war of the 70s, earning him the highest medal for his heroism.
Ato Brehanu continued that the committee’ selection of the three honorees for this year, which includes Militia Ali Berke along with Gen Tesfaye and Gen Kassaye, was due to their superior contributions in line of duty and in defense of Ethiopia’s unity and territorial integrity in both northern ad eastern fronts during the 70s and 80s . That they were selected for this years’ event among thousands of others with equally superior heroic deeds in line of duty. He mentioned the fact that the two generals have made significant contributions to tell the Ethiopian people about the stories of heroic sacrifices made by the former armed forces in order to defend Ethiopia from both external and eternal challenges posed to the country’s unity and territorial integrity.
The chairman of the committee also mentioned the unsuccessful but much effort exerted by the committee to locate the whereabouts of the third honoree, Militia Ali Berke and facilitate his travel to the USA for the occasion. Ato Berhanu said that the committee would work hard to encourage historians and others to write about the exemplary gallantry of the former armed forces so that they are recorded in the annals of history and passed on to generations of Ethiopians yet to come. He concluded by announcing the committee’s grand and long term plan, at an appropriate time, to erect a monument in Ethiopia in memory of the tens of thousands of Ethiopians who laid their precious life while heroically fighting in defense of Ethiopian unity and territorial integrity from challenges posed by external and internal forces.
Following a moving poem read by Maj. Kifle Abocher, among the ablest artists who served in the former armed forces, Ato Ayalkibet Teshome, a member of the organizing committee read the biographies and contributions of General Tesfaye Habte Mariam, Gen Kassaye Chemeda, and Millitia Ali Berke. Artist Tamagne read a brief biography and introduced Brig. General Wubetu Tsegaye to present the special award to both General Tesfaye and General Kassaye, both of whom served under his command. Brig General Wubetu Tsegaye is a decorated war hero and one of the ablest leaders of the former armed forces and an officer who rose from Battalion commander as a Major to a Brig General and the commander of what was then known as the second revolutionary army (SRA) in the northern front during the 80s for close to fifteen years. While members of organizing committee lined up in straight lines at both the left and right sides of General Wubetu, General Kassaye and then General Tesfaye came forward, gave military salute and received their awards from Brig Gen Wubetu Tsegaye. The awards presented to both are embossed with the letters “Le Mayiresa Wulleta, “For a great deed that shall never be forgotten”.
That rare and emotionally touching moment brought tears to many who were present. It continued when Gen Kassaye Chemeda took the stage. Gen Kassaye stated that he willingly joined the then Ethiopian army during the time of the Emperor to serve and for love of the symbol of our nation, pointing towards the standing Ethiopian flag next to him. He told the audience that he never expected that he and the rest of the former Ethiopian armed forces, who served the country through thick and thin as professional soldiers and officers, would get the chance to be remembered and given such recognition and honor during his life time. He related the suffering he had to endure since his two years of imprisonment after the aborted attempt to oust Col Mengistu in 1989. Gen Kassaye was also a victim of the current regime which put him in prison for another eight months after the fall of the Derg regime.
Gen Kassaye concluded his brief speech by telling the crowd that all the demoralizing stigma and labels he carried along with the rest of the former Ethiopian armed forces for the past so many years has been completely washed in that historic day organized to honor and cerebrate Ethiopian heroes. Thus, expressing his deeply felt gratitude for the committee and the hundreds of Ethiopians present at the occasion. Then Brig General Tesfaye took the stage. He too spoke briefly emphasizing that he is a soldier through and through and whenever he was called upon, he has served the Ethiopian people as a professional soldier. He then recounted three stories, among many other stories yet to be told, as illustrations of the former Ethiopian army’s heroism which defied the known and practiced military science all around the world. After expressing his enormous joy for being able to be present in an occasion of such honor , General Tesfaye recalled that it was exactly on Sept 12, thirty years ago that he was awarded the highest medal for heroism, Ye Hibretsebawit Ethiopia Woder Ye Lelew Jegna Medaliya. He stressed that he considers the current award given to him one that is beyond any expression, calling it Ye Woder Woder Yelesh moment for him.
Dressed in uniform and the Red Hat of the Airborne, Artist Tamagne Beyene took the stage again, announcing to an applauding and amused audience the next program of showing two special documentaries he produced for the occasion. The two films showed among the most dramatic moments in the lives of the two generals, including the tragic story of a successful but enormously costly breakthrough led by General Tesfaye at Nakfa, in one of the most difficult rugged terrain and stronghold of the then Eritrean rebels. Against all odds, General Tesfaye, then a Captain and his airborne battalion, undertook one of the rarest heroic missions by volunteering to be sent in response to the 15th battalion's telegram of appeal for support and dropping from an airplane at more than 2000 meter height. A heroic feat that defied the normal practice and unheard of in modern history of Airborne missions anywhere around the world. That mission was undertaken in order to support and save the encircled and embattled 15th battalion at Nakfa led by Maj. Mamo Temtime. The film also depicted the tremendous heroism and determination of post humus Lt. Colonel Mamo Temtime, the commander of the heroic 15th battalion, who led his men to withstand and put up the toughest resistance in the face of the bloodiest encirclement and onslaught by a much superior enemy force at Nakfa for several months, until he was wounded and while fighting to the last bullet. The short documentary prepared to honor General Kassaye showed his enormous contributions starting with his heroic role as a commander of a Tank Battalion that made significant contribution of crushing and ousting the Somali invading forces out of Ethiopia’s territory.
Upon the conclusion of this part of the evening program, an applause and hurray filled the hall, an expression of approval for work well done as tribute to the heroes by Artist Tamagne. Artists Desalgen and Aregahen Worash continued entertaining the huge number of Ethiopians in the hall with patriotic songs until about 2:00 AM in the morning.
Saturday night event got coverage by the Voice of America. Many members of the media in the Washington DC area were also present. Also present were members of various civic groups such as Gasha for Ethiopia and many others. Ethiopians from all walks of life, young and old, woman and men, were present. Many young Ethiopians as far away as Minnesota, Cincinnati, Ohio, New York and other states came to be part of this great event as well.

The following list of names is prepared to serve as a symbol of hundreds of thousands unnamed others, who died in line of duty and as well as alive. These are outstanding leaders and heroes, both alive and dead, from the former Army, Navy, Air force, and the police forces. This is just representative list of heroes from Generals to line officers, from NCOs to privates of the former Ethiopian armed forces

Open letter to UN Sec.-Gen. Ban Ki-moon
Posted to the Web: August 22, 2009
H.E.
Mr. Ban Ki-moon
United Nations Secretary-General
1st Avenue, 46th Street
New York, NY 10017
August 21, 2009
Your Excellency:
We, the representatives of various Ethiopian professional, civic, political, and cultural organizations, have the honor to bring to your attention a grave situation that is developing all along the border between Ethiopia and the Sudan. Recently, the Sudanese government has been engaged in an all-out effort to seize control of Ethiopian territory illegally. Toward that end, it has sent elements of its army to forcibly evict Ethiopian farmers from their lands, and has killed some and detained others in Sudanese jails. The Sudanese government has taken these brazen actions in total disregard of Ethiopia’s sovereignty and in violation of the fundamental rights of the aggrieved persons under applicable rules of international law.
The boundary between the two countries has been the subject of numerous negotiations since colonial times. But it is only in the last decade and a half that the Sudan has felt emboldened to resort to the use of force to settle its boundary dispute with Ethiopia. The Sudanese government apparently believes that it has arrived at an opportune moment in history to drive a hard bargain and to fulfill its territorial ambitions. The dictatorship in Ethiopia headed by Prime Minister Meles Zenawi is so weak and so obsessed with hanging on to power at all costs that it regards these territorial claims as a ”small price” to pay for securing Sudan’s cooperation in crushing Ethiopian resistance movements with bases in the border region.
Negotiations between the leaders of the two regimes have been ongoing since the beginning of the 1990s. They recently culminated in an official meeting in Addis Ababa from April 21 to April 22, 2009 where Prime Minister Zenawi and General Al-Beshir of the Sudan signed off on a deal that covered a variety of bilateral matters including -- crucially -- the recognition of Sudan’s claims to Ethiopian territory. We have learned to our utter shock and dismay that under the just-concluded deal, huge swathes of our ancestral lands have been ceded to the Sudan with a stroke of the Ethiopian dictator’s pen.
We wish Your Excellency to take note that we reject absolutely and condemn vehemently this nefarious deal between the two dictators. We wish to let it be known that we will never allow this deal to stand, for it deprives thousands of our people of their farms and holds for naught the enormous sacrifices our forefathers have made so valiantly to preserve these lands as an integral part of Ethiopia’s territorial identity and sovereignty. We would like to remind the world community of the fact that Emperor Tewodros II (1818 – 1868) cut his teeth on defending these very lands from Egyptian and Sudanese encroachments in the 19th century. Those who seek to deprive us of these lands would also do well to remember that Emperor Yohannes IV (1831 – 1889) gave his life and immortalized his name in the defense of these same territories from similarly motivated forces. In short, so hallowed is the history associated with these lands and so deep-seated the passions it evokes among Ethiopians of every generation, it is foolhardy to expect the Ethiopian people to acquiesce in Zenawi’s treasonous act and to take Sudan’s land grab lying down. Let this note serve as a warning that we pledge to vindicate our national rights and honor by all necessary means. For a nefarious deal concluded by an illegitimate and quisling government deserves only to be honored by its breach.
Your Excellency should know that the current Prime Minister of Ethiopia has no authority - legal or moral - to enter international agreements that cede Ethiopian territories. To the contrary, a fundamental and venerable principle which Ethiopians have repeatedly affirmed in the course of their history is that which denies to their rulers – even to those who claimed to rule by divine grace - the authority to voluntarily cede territory to foreign powers. As recently as the time of the late Emperor Haile Selassie I (1892 – 1975), binding international boundary settlements had to obtain the imprimatur of the people’s representatives. Meles Zenawi too will be hard pressed to point to anything in the constitution of the country or its traditions which allow him to override this immutable principle against voluntary territorial cessions without the participation and consent of the Ethiopian people as expressed through its chosen representatives. There is no more vivid or better demonstration of the tenacity with which this principle is upheld in Ethiopia than the ill-fated rulings of The Hague Boundary Commission which conferred Eritrean sovereignty over lands that have historically belonged to Ethiopia. As you know, these rulings ultimately proved a dead letter for no other reason than that the Ethiopian people found them to be at war with this time-honored principle. And not because Meles Zenawi was unwilling to oblige, give in or give up. He was. But for the Ethiopian people, neither the Commission’s international standing nor Meles Zenawi’s too clever-by-half ramblings urging acceptance of the Commission’s rulings were of any consequence. The Ethiopian people know like the back of their hands where Ethiopia’s territory ends and foreign territory begins. They will not seek what is not theirs; but they will not willingly give up what they know to be theirs, even when those at the helm of state power are willing to betray the national interest in the service of selfish and shortsighted personal or group ambitions. In short, we wish it to be understood that territorial cessions or concessions that have been made by the Prime Minister (and his cohorts) behind the back of the Ethiopian people -- and contrary to their wishes and interests -- will only last as long as the life of the regime; not a day longer.
Of course, we are not surprised that Sudan’s leaders have acted with transparent opportunism in seeking to extract territorial gains from a weak and insecure regime that they intimately know to be wracked by internal dissent and a serious deficit of democratic legitimacy. We are not unmindful of the usual proclivity of governments to seek to promote their perceived national interests. Nevertheless, we believe in this case that the government of General Al-Beshir has unwittingly planted the seeds of an inevitable future conflict and instability and thereby jeopardized his country’s long term interests by seeking to secure territorial gains at Ethiopia’s expense courtesy of a leader who he knows to have no qualms about putting “his” country’s interests on the auction block so long as doing so prolongs his rule.
The Sudan should also understand that there is no historical, legal, or demographic justification to its claims over any of the Ethiopian territories in question. The only slender reed on which it bases its claim is a colonial-era treaty between Ethiopia and Great Britain which does no more than purport to define the territorial limits of Ethiopia and the Sudan. (Sudan is, of course, a successor state of Great Britain under international law and would stand in the shoes of its erstwhile colonial ruler as far as its treaty rights are concerned.) But the treaty is devoid of anything that favors Sudan’s position. To begin with, since the circumstances of the making of the treaty during the heyday of British colonialism were so murky, the legal validity of the treaty is open to question. Legal validity aside, however, it is worth noting that the treaty merely delimits the boundary between the two countries in very general terms, expressly leaving the task of actual boundary demarcation to a later date. That date, however, never arrived and, as a result, the demarcation of the common boundary has proved elusive from the day the treaty was inked. To be sure, Sudan has at various times claimed that the boundary between the two countries has in fact been demarcated. The claim, however, has no support in historical fact or law. A legally binding demarcation requires the cooperation, participation, and consent of both sides. Indeed, the 1902 treaty itself explicitly calls for both sides to set up a joint demarcation body. This, however, never materialized. Instead, a certain Major Gwynn of the British colonial office seems to have singlehandedly sought to demarcate the entire Western length of the border between the two countries soon after the treaty was allegedly signed. But this unilateral and self-serving act cannot be held to determine Ethiopia’s rights or foreclose her rightful claims. A valid and binding demarcation takes the consent of both sides. This principle is too well known and too established under international law to even require mention were it not for the contrary pretensions of the Sudanese government and Zenawi’s complicit acquiescence. Moreover, a legitimate demarcation requires the participation and the cooperation of the denizens of the borderlands. The importance of such a procedure too is obvious and does not need elaboration. Yet, this too has not happened to date.
It is against this backdrop that in April, 2008, elements of the regular army of the Sudan entered Ethiopian territory and forcibly evicted our citizens from their farms, destroying in the process their crops, flour mills, tractors and other farm equipment. Twenty-four settlements were razed to the ground. The natural vegetation and wild animals that grace this region were not spared from wanton destruction. Following these unlawful acts, we addressed a letter dated June 2, 2008, to President Al-Beshir decrying these misdeeds and putting the Government of the Sudan on notice of its responsibility for its actions. Unfortunately, we have seen no evidence that the Sudan government is willing to change course and to desist from its unlawful and arrogant behavior. On the contrary, just recently, the Sudanese army once again went on the offensive and murdered seven more of our citizens while they were tending their farms. We strongly condemn these actions.
Despite the brutalities and indignities our citizens continue to suffer at the hands of the Sudanese army, their “own” government has not cared to seek legal redress for these transgressions. On the contrary, Prime Minister Zenawi had the audacity to extend an official invitation to Al-Beshir to visit Ethiopia from April 21 to April 22, 2009 in the teeth of the International Criminal Court’s indictment against him for a variety of international crimes. For now, our citizens seem to have no legal wherewithal in the face of the obstacles placed in their path by the two dictators. Nevertheless, we the undersigned consider it our duty and responsibility to register with Your Excellency our protest and condemnation of these unlawful actions.
We would also like to go on record as asserting our inalienable rights to self-defense, to our sovereignty as a people, and to our territorial integrity as a member of the United Nations. We reserve the right not to honor any boundary agreements that the regime of Meles Zenawi has signed with the Government of the Sudan without the knowledge and full consent of the people of Ethiopia.
Finally, we demand that the government of the Sudan immediately withdraw its army from Ethiopian soil and maintain scrupulous respect for the sovereignty and territorial integrity of Ethiopia and pay adequate compensation to the victims of its actions and their survivors, and for the loss and destruction of their property.
Please accept the assurances of our highest consideration.
Sincerely,

The re-arrest of Birtukan Midekssa signifies the long-standing violation of rule of law
UDJ press release | January 3, 2009
The letter of the President of the
Federal Democratic Republic of Ethiopia dated Hamle 12, 1998 (July 19, 2006)
guarantees that Woizerit Birtukan Midekssa, accused of “attempting to overthrow
the Constitution and the constitutional system by force," has been granted
full pardon. The pardon certificate given by the President further guarantees
that the full pardon would hold as long as W/t Birtukan did not participate in
similar actions, carries out her civic responsibility of respecting and
defending the Constitution and accepts and respects the duties and
responsibilities of government institutions established under the Constitution.
W/t Birtukan has in no way violated the preconditions to which she had committed herself. Nor is there any accusation from the government based on a violation of the preconditions.
Proclamation No. 395/1996, Article 16 identifies the conditions under which pardon is granted. Among these are:
a) After the pardon decision
reaches the beneficiary of the pardon, if it is ascertained that the pardon had
been obtained through falsification or deceit, it is decreed that the pardon
could be revoked.
b) If the pardon is granted under a precondition and later that precondition is
violated, the law decrees that the pardon be revoked.
The pardon granted to W/t Birtukan was revoked, according to a government statement broadcast through the media, under the pretext that she had denied asking for pardon. This could in no way be taken as an action that warrants the revocation of a pardon. This being the case, when the pardon that was given to W/t Birtukan was revoked, the procedure stipulated by the law has been fully violated.
According to the procedures stipulated by Proclamation No. 395/1996, Article 17, when there is an adequate condition warranting the revocation of a pardon, the reason for the revocation has to be made clear and given to the receiver of the pardon in writing. However, W/t Birtukan was taken to prison in a manner that violated her human rights, without a written notification according to the law and without the benefit of the 20 days granted to her by the law for examining the charge and for making her response.
Because W/t Birtukan has not violated the precondition under which she was granted pardon; because the pardon was revoked in a manner that violated the procedures stipulated by the law and because the violent manner in which she was arrested and taken to prison violated her human rights protected by the Constitution, the law calls for the revocation of the pardon to be annulled and for the pardon granted earlier to be confirmed.
In view of the fact that W/t Birtukan is the Chairperson of the Unity for Democracy and Justice Party (UDJ), it is believed within the UDJ, that the illegal measures stated above are designed to hinder the activities of the party. On December 29, 2008, at about 2 pm, W/t Birtukan was arrested by individuals who did not identify themselves or produce a warrant in a manner that violated her human rights. Professor Mesfin Woldemariam and her chauffeur, Ato Abdurahman Ahmmed, who happened to be with her at the time, were also physically beaten. The illegal acts described above indicate not only the violation of the rule of law but also the trampling of human and constitutional rights of citizens.
The Ethiopian people must note that the illegal measures taken by the government against the Chairperson of UDJ go beyond Birtukan as an individual and are aim at the existence of our party. UDJ wishes to make it clear that W/t Birtukan, its Chairperson, has the full support of her party that firmly stands by her side.
Furthermore, UDJ declares as being out of the truth and not representing the position of the party, a statement made by the December 30 issue of Awramba Times in connection with the arrest of W/t Birtukan and quoting Dr. Hailu Araaya as saying:”It has been pointed out to us that this is the private affair of W/t Birtukan and concerns her and her alone.”
UDJ calls upon the Ethiopian people to take note of what is behind the measures taken against W/t Bitukan, to stand behind UDJ and to redouble its efforts to strengthen the peaceful struggle to bring about democracy and the rule of law in Ethiopia. It also calls upon governments and other international institutions dedicated to the cause of human rights, democracy and the rule of law to be supportive partners of our common cause.
